We publish a communiqué made available by the Małopolska Regional Chamber of Architects of the Republic of Poland regarding the competition for the construction of multi-family residential buildings organized by the Sącz Society for Social Construction.

Concerning:
1. competition for the development of an architectural and spatial concept for the task entitled "Construction of multi-family residential buildings with commercial and office premises ("Osiedle Graniczne"), with underground garages, land development and technical infrastructure, located on plot no. 103/39, obr. 120, at Myśliwska Street in Nowy Sącz".

2. competition for the development of an architectural and spatial concept for the task called "Construction of four multi-family residential buildings with commercial and office premises ("Zakole Dunajca"), with underground garages, land development and technical infrastructure, located on plots no. 3/14, 3/15 , obr. 112, at Tłoki Street in Nowy Sącz- Building 2".

Having reviewed the terms and conditions of the competition in question, the Team of Conditions of Practice [hereinafter referred to as ZWWZ] at the Council of the Małopolska Regional Chamber of Architects of the Republic of Poland draws the attention of Fellows to the issues that should be taken into account when deciding whether to participate in the proceedings in question. As a result of the audit of the competition conditions and the ToR, the ToR negatively assesses the competition conditions and the substantive preparation of the jury, and thus strongly advises MPOIA members and other Architects against participating in the competition in question.
Key irregularities:
1. the competition schedule, which is unrealistic in the opinion of the AGM.
2. Inappropriate composition of the Competition Jury.
3. inadequate requirements in terms of qualifications and professional experience.
4. grossly underestimated honorarium, inconsistent with the regulation of the Minister of Development and Technology on determining the methods and bases for preparing the investor's cost estimate, calculating the planned costs of design works and the planned costs of construction works specified in the functional-utility program.
5. payment of fees subject to factors beyond the influence of the competition winner.
6. inappropriate, dangerous for participants provisions on the transfer of copyrights.
7. The type and amount of prizes in the context of requirements for the transfer of copyright.
8. Inadequate starting materials for design (lack of subsoil tests),
9. Lack of completeness of the competition materials provided to participants.
